The property adjoins established residential development on two boundaries. It has frontage to Chippendale, Betina, Joy, Craig and Spiller Streets – except for Craig Street, all other streets are formed / sealed carriageways. The Burdekin Shire Council’s Planning Scheme Zone Map (see attached) shows that the subject property is one of about only 3 englobo properties in Ayr adjoining established residential, that are zoned for residential development. The Council has in past years had increasing pressure / demand by adjoining cane farmers to allow rezoning of their property for residential development. The Council to date has resisted the move, preferring to see / encourage development in line with their existing town plan. The Council has in fact in the past approached the owners of the property on offer to see if they would consider developing the property. Some preliminary investigation has indicated that conservatively 350 to 390 eight hundred square metre lots are possible.

The property is currently used for the growing of sugar cane. The owners would be interested in leasing the property back after settlement and continue using the property for sugar cane production until such time as the property may be required for development.
